In order to comply with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its applicable Regulations and Guidelines (the " Law "), WeHelp Safety, Inc., its affiliates and/or subsidiaries, and /or its related parties (“ WeHelp ”), with address at Av. With the purpose of giving a legitimate, controlled and informed treatment to your personal data, that you currently provide us or in the future and that work in our databases, or that have been collected by cookies, or any other technology of web monitoring, as well as to guarantee your privacy and your right to informative self-determination when providing us with said data, WeHelp being responsible for the use and protection of your personal data, which will be treated based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility provided for in the Law.

What Data Does WeHelp Collect?
Data You Provide to Us
WeHelp collects data that you provide to us when you create an account such as full name, email address, phone number, birthday, gender, country and city of location, precise location, and access to geolocation. We may also collect other sensitive personal data such as blood type, chronic diseases, allergies, weight, height, and any other data that you voluntarily and explicitly provide to us.
Sensitive Personal Data may be requested by electronic or physical means, with the understanding that all information provided in physical form will be considered and treated as if it had been provided and authorized on the Site and/or the Platform, and for which it will be governed for the present document.
Location Data, even when the app is closed or not in use
If you opt in to sharing your location with us, we will automatically receive data about your precise location such as latitude-longitude coordinates whenever you use WeHelp; for example, when opening or interacting with WeHelp. If you opt in to have a background location on WeHelp, we will collect data about your location when you are not using the app or the app is closed.
We use various technologies to determine your precise location, such as location services from your operating system or browser and sensor data from your device such as magnetometer, barometer, gyroscopes, accelerometers, compasses, Bluetooth data, GPS data, and cell tower. Remember that you can remove your consent to share your background location data permission at any time by going to your operating device settings and turning off background sharing.
Data Collected Automatically When You Use WeHelp
We may also collect additional data about you when you use WeHelp. For example:
- device information, such as your hardware model, operating system and version, unique ID and device data such as device identifiers, IP address, sensor data, browser type, language, and wireless network, mobile device name; and
- data from cookies, pixels and other technologies, such as cookie ID, advertising ID or other unique advertising ID, web beacons, and local storage. You can control certain types of cookies through your browser settings or other tools.
WeHelp may also collect your Internet Protocol (IP) address to help diagnose problems with the WeHelp server and to administer the Site and Platform. An IP address is a number that is assigned to your computer when you use the Internet. Your IP address is also used to help identify you within a particular session and to gather general demographic information. WeHelp may use "push" technology to send notifications with the prior authorization of the User. This means of communication does not have any type of access to other functions or information of the equipment with which it connects to the Site. The information may include the URL they come from (whether or not they are on the Site), what URLs they go to next (whether or not they are on the Site), what browser they are using, as well as pages viewed, searches performed, publications, commercial preferences, messages, etc.
In all cases, the collection of Personal Data by WeHelp is carried out in good faith and for the purposes set forth herein; for this reason, it is presumed that the data provided by their owners are true and complete, so they are the responsibility of the owner who provides them.
2. . How Is My Data Used by WeHelp?
To Operate, Maintain and Improve WeHelp
The information that you provide us when creating your account on the Site and/or on the Platform, and/or email, and/or filling out forms or physical or electronic surveys, in real or historical time, will be processed and ordered, so that it generates indicators of data, which WeHelp may use to make decisions relevant to you. All the information that is collected will be used for statistical purposes, in a generic and non-personalized way, and is associated with the growth, maintenance and administration of WeHelp, respecting your privacy at all times.
These uses include our internal operations and administration, communication with you, and fulfillment of requests for services and/or products provided by WeHelp, as well as to improve, develop, refine, and provide WeHelp services, through its parts. affiliates, affiliates, or authorized providers and/or business partners, establishing the appropriate measures in order to limit the use of the information collected from you, only for legal and authorized purposes in accordance with this Notice, as well as with the appropriate confidentiality measures. and security.
The features and functionality of WeHelp requires your location to operate, maintain, and improve our service. If you have location services turned on, we collect and use your geographic coordinates, such as latitude and longitude, to ensure that we send assistance to your exact location. If you have persistent background location turned on, we'll get your device's location even if you're not using the app or it's closed. Your location is not shared with others except first responders and your contacts in your safety network.
We also use your data to improve the Consumer Services and our business, to conduct research and development, to perform analytics, to develop and offer new products and services, and to infer certain details about you. For example, we may customize the Service to allow you to add friends from your device's contact list to be part of your safety network. We do not store your contact lists. As another example, we also use your data to help us map Locations. For example, we may use device signals to determine that a particular device is within a specific location. Also, if you consent to sharing error data (when apps crash) with us, we may use that data to help us analyze the cause of the error and improve our services.
To Provide You Assistance
The Personal Data provided by the Clients, in addition, serves to provide the intermediation service through alerts between: (i) the Client and third parties through a Public Security Answer Point; (ii) the Client and his/her safety network/emergency contacts; (iii) the Client and other nearby Heroes. Heroes are defined in the Terms and Conditions of Use of WeHelp (the “Services”) consist of personal information that is included or may be included in formats, lists, databases or other means physical and/or electronic, as appropriate, so that WeHelp can provide the Services through the Platform.
- CLIENTS, AS USERS OF THE PLATFORM. The Personal Data that will be collected from the Clients who make use of the Platform are necessary to document the commercial and legal relationship that exists or may exist with each of them. The Personal Data that you will voluntarily, explicitly and freely provide to WeHelp, consists of information that is included or may be included in contracts, letters, forms, lists, databases or other physical and/or electronic means, as appropriate, in order to WeHelp can document the relationship between the parties, the process of use and selection that you make or will make of the Modules that make up the Platform Services; can keep proper records of the business relationship with its business partners; as well as to fully comply with the internal policies, procedures and other legal obligations applicable to WeHelp.
The Personal Data provided to WeHelp through the Platform will be also used with the purpose of:
- processing data that allows creating a record of Clients and Services that you use, through the Platform.
- derived from the services offered by WeHelp, to make available to you the most appropriate service in case of emergencies and intermediation of contact with third parties.
Once the purposes of the processing of your Personal Data have been fulfilled, and when there is no legal provision that establishes otherwise, WeHelp will proceed to the cancellation, elimination and/or destruction of the Personal Data received, in the terms established by the Law.
Use Of Location-Based Data
WeHelp, with your consent, uses your location data even when the app is in the background or closed to:
- enable alert monitoring;
- movement detection;
- location sharing;
- share your location with your safety network contacts;
- know if you are on the move in order to send you status notifications; and
- share your location with our bodyguards in case of requesting assistance.
Your location is not shared with third parties, with the exception of requiring first responders (ambulances, patrols, firefighters) to be sent to your location.
Communicate With You
We use your data to communicate with you by phone, email, text message or within our app about our services, new features, updates and membership.
Use Of Cookies
WeHelp informs you that, through the use of cookies and similar technologies, it seeks to guarantee the best possible experience on the Site and/or the Platform, by providing you with personalized information, remembering your service and marketing preferences and helping you to obtain the adequate information. In case you require more information regarding the use of cookies and similar technologies, WeHelp makes the Cookies Use Policy available to.
3. When Is My Data Shared?
We may share certain data about you as further described in this Privacy Policy or when you have given us consent to do so. Your location data may be shared with a) first responders and/or heroes to ensure that we send assistance to your exact location, if necessary, and b) with service providers/third parties/affiliates for application operations and functionality.
Data May Be Shared With Third-Parties
We use SDKs and other third party systems for analytic, payment and in-app calling purposes.
WeHelp, and/or its controlling companies and/or affiliated companies and/or subsidiaries and/or related parties (the " Related Third Parties ") and/or those third parties who, due to the commercial relationship with WeHelp, have contracted the use of the Platform to complement their service proposal and have the need to process and/or use their personal data (the " Client "), request and obtain personal data in general, as well as personal data considered sensitive by Law (hereinafter “ General Personal Data ” and “ Sensitive Personal Data ”, respectively, and jointly referred to as the “ Personal Data ”) of the persons hereinafter described.
Data May Be Share With First Responders
We do not disclose any personal, sensitive or financial information with third parties for business, analysts, or marketing. WeHelp only shares personal and sensitive information such as name, age, gender, location data and others with first responders if you request assistance due to an emergency. We share the Clients information for first responders to assist as fast and efficiently as possible without the Client to give numerous details while in an emergency. For example:
- Annie sent a traffic alert via WeHelp, our Agents communicated with her to assist her. However she hit her head and is very confused. Due to the situation and accident our Agents will contact first responders and provide Annies information as to where exactly she is in, her name, age, gender, and the necessary information to support Annie during this tragedy.
4. When Is My Data Transfer?
The Personal Data referred to in this Notice may be transferred to: (i) related third parties, including without limitation, the Heroes, the Authorities, other related third parties for the purpose of enhancing WeHelp's value proposition; (ii) Mexican and foreign judicial authorities, in order to comply with the Law, legislation, notifications, requirements or judicial orders; (iii) to internet service providers on which WeHelp's technological infrastructure is mounted; and/or (iv) to providers of technical support services of the Platform. In case of making any transfer of your Personal Data, in which your express consent is required, we will inform you in order to collect it.
In all cases, WeHelp will communicate this Privacy Notice to these third parties and will ensure, through the signing of agreements and/or the adoption of other binding documents, that said third parties maintain the necessary administrative, technical and physical security measures to safeguard your Personal Data, as well as that said third parties only use your Personal Data for the purposes for which they were collected. Likewise, both the Client as the person responsible for collecting the Personal Data and WeHelp that facilitates the collection and processing of the same through the Platform, as well as any other person related to WeHelp who has access to the information contained in this Privacy Notice, They will be obliged to protect it under the same security and confidentiality standards, and not reveal or misuse it, or otherwise they will be responsible in accordance with the applicable laws.
Notwithstanding the foregoing, WeHelp will not transfer your Personal Data to third parties not related to WeHelp, except in the aforementioned cases and those provided by law, without your prior consent.
You agree and are aware that by issuing an alert or contacting the WeHelp Contact Center, WeHelp may transfer your Personal Data to third parties in order to provide you with the most appropriate services.
5. Your choices about your information
You may, of course, decline to submit any personal information through the Service, in which case WeHelp may not be able to provide its Services to you.
Modifying Your Account Information and Settings:
You may modify your account information, update or amend your personal information, or change your password at any time by logging in to your account. If you have any questions about reviewing or modifying your account information, you can contact us directly at privacy@lovewehelp.com .
Close Your Account or Delete Personal Information:
We retain your information for as long as your account is active or as reasonably necessary to maintain the Service, meet legal and accounting obligations, and for the other purposes described in this Privacy Policy. If you wish to close your account, and/or request to delete your personal information, please contact us at privacy@lovewehelp.com. When account information is deleted or de-identified, certain residual information may remain within our archive records, such as for customer and technical support, billing and tax purposes.
Emails and Notifications:
You can control your receipt of email and text alerts by visiting “Settings” and “Alert Options” within the mobile app. You can also stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in such communications. You may not opt-out of Service-related emails (e.g., account verification, parental consent notification, order confirmations, change or updates to features of the Service, technical and security notices). You may also unsubscribe from receiving SMS text messages by replying “STOP” to the number sending the message. We make every effort to promptly process all unsubscribe requests.
Location and Movement Data Collection and Sharing:
As described in Section 1, we collect precise location data and driving event and movement data (such as accelerometer data, magnetometer data, gyro data, etc.) from your device to provide the WeHelp Services, and may share your personal information, including location and movement data, with other WeHelp users in your Safety Network or first responders and with third parties for research, analytics, attribution and tailored advertising purposes. You have many options to control this data collection and sharing activity through the App Settings.
6. Means And Procedures For The Exercise Of ARCO Rights
You, as the owner of the Personal Data provided to WeHelp , may request at any time, the exercise of your rights of access, rectification, cancellation or opposition (the " ARCO Rights ") to the processing of your Personal Data, consisting of: (i) accessing your Personal Data and the details of their processing; (ii) rectify your Personal Data if it is inaccurate or incomplete; (iii) cancel your Personal Data when you consider that they are not required for any of the purposes indicated in this Privacy Notice, are being used for non-consensual purposes or have terminated your contractual or service relationship or another with WeHelp ; and (iv) object to the processing of your Personal Data for specific purposes.
For this purpose, you must follow the process of submitting your request in writing to WeHelp, or send your request to the Email, as applicable, which must contain, at a minimum, the following information: (a) your full name and address, or other suitable means to communicate the response to your request; (b) the documents that prove your identity or, where appropriate, that of your legal representative; (c) the clear and precise description of the Personal Data with respect to which one seeks to exercise any of the aforementioned rights; and (d) any other element or information that facilitates the location of the Personal Data, as well as any other document required by the current regulation at the time of submitting the request. You may also request more information by email about the procedure to exercise your ARCO Rights .
The response to your request will be made known to you by WeHelp in the terms and periods established in the Law. However, you may obtain more information about the status of your request and the response time of the same, by contacting WeHelp or sending your request to the Email, where you can also address any clarification or doubt you may have regarding the processing of your Personal Data and the exercise of your ARCO Rights.
7. EU, UK, and Switzerland Users
Your Rights
Subject to applicable law, you may have a number of rights regarding the processing of your Personal Data, including:
- the right to request access to, or copies of, your personal data that we process or control, together with information regarding the nature, processing and disclosure of that personal data;
- the right to request rectification of any inaccuracies in your Personal Data that we process or control;
- the right to request:
- deletion of your personal data that we process or control; or
- restriction of processing of your personal data that we process or control;
- the right to have your personal data that we process or control transferred to another data controller, to the extent applicable;

. How Do We Protect Personal Information?
We maintain administrative, technical and physical safeguards designed to protect personal information we obtain through the app against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.
All sensitive data is handled securely and transmitted over HTTPS. All payments are handled securely through Stripe, see Stripe’s privacy policy here https://stripe.com/privacy . We do not upload or store your phonebook and contacts information, unless you add them to your safety network.
9. Changes To The Privacy Notice
WeHelp reserves the right to modify and/or update this Privacy Notice, in some or all of its parts, at its sole discretion, in which case it will communicate it here through its Site and/or the platform; and, depending on the particular case of each holder, through their internal networks, or by means of a notice that will be placed in the usual means of communication (physical or electronic) of WeHelp and in a visible place of the Home, or by means of a written notice addressed to your email, as legally required.
10. Digital, Electronic, Or Online Form
The Parties agree that the form to perfect the agreement of wills between them may be in Digital, Electronic or Online format, where it will suffice to express their will by means of their acceptance through the Electronic signature.
